THE PARTIES

don Quijote UK In-Country Language Courses Ltd (hereinafter called “don Quijote”) whose registered office is at 2/4 Stoneleigh Park Road, Stoneleigh, Epsom, Surrey KT19 0QT organises and acts as agent for overseas bodies which offer and supply students and others with tuition and accommodation, for in-country language courses, and may arrange insurance for students. don Quijote as agent effects all bookings and reservations for students unless notified to the contrary, and it may, at is discretion, intercede, without charge on behalf of students who become in dispute with any persons or bodies in connection with any matters arising provided however that don Quijote shall not thereby be liable or become liable in any way in connection with any such matter nor does it vouch for the content or accuracy of any brochures or publicity documents prepared for students by any such persons or bodies and it is accepted that students’ possible remedies shall be against such overseas bodies only.

“The student” means a person or persons who have signed the application form for such an in-country language course (or if under age a parent or person in loco parentis of such person or persons). Where a booking is made for more than one student the body or organisation making the booking will be regarded as the student for the purpose of this agreement. In consideration of the price agreed to be paid for its Principals’ courses and accommodation as set out on the Registration Form the following terms and conditions shall apply as between the parties:

1. GENERAL

  1. DON QUIJOTE ACCEPTS NO RESPONSIBILITY WHATSOEVER FOR CASES OF FORCE MAJEURE (ACCORDING TO LAW) OR FOR STUDENTS’ ACTIONS.
  2. THE DON QUIJOTE MANAGEMENT RESERVES THE RIGHT TO ACCEPT STUDENTS AGED 17 IN EXCEPTIONAL CASES.
  3. ON FORMALISING ENROLMENT ON A COURSE (AND ACCOMMODATION) OVER THE INTERNET, BY FAX, ONLINE BOOKING OR WRITTEN ENROLMENT FORM STUDENTS ACCEPT THE GENERAL AND PAYMENT CONDITIONS AND PAYMENT METHOD AS WELL AS THE NORMS, RULES AND GUARANTEES OF DON QUIJOTE THAT THEY HAVE BEEN PREVIOUSLY GIVEN AND READ.
  4. DON QUIJOTE’S MANAGEMENT RESERVES THE RIGHT THAT IN THE EXCEPTIONAL CASE THAT ONLY 1 OR 2 STUDENTS ARE ENROLED ON A COURSE IN THE SAME LEVEL GROUP, THE NUMBER OF CLASSES PER WEEK WILL BE REDUCED SLIGHTLY.

ARTICLE 1 - THIS AGREEMENT

  1. The specific written approval of don Quijote is required for any variation to this agreement.
  2. The Law of England shall apply to this agreement.

ARTICLE 2 - PAYMENT CONDITIONS

  1. An advance payment of £85 is to be sent to don Quijote with a completed registration form for each student enroling. For Kids, Juniors and Teen programmes the advance payment is £205.
  2. The remaining balance must be settled by the student and arrive at the office of don Quijote no later than 2 weeks days prior to the start date (for Kids, Juniors and Teen programmes no later than 4 weeks prior to the start date). In the event of default of payment by that time don Quijote shall be entitled to rescind this agreement in which circumstances the amount already paid is accepted by the student as being non-refundable. don Quijote reserves the right to sue for the balance payable or the whole booking.
  3. Where a booking is made within 2 weeks prior to course start date (for Kids, Juniors and Teen programmes within 4 weeks prior to course start date) the entire costs of the course and accommodation shall be paid at the time of registration and the total amount due for the course and accommodation must be received by don Quijote in time for funds to have been cleared the day before departure in which case payment may be needed by bank transfer or such other suitable means to achieve this at the expense of the student.
  4. Due to currency fluctuations prices may be subject to change.
  5. All bank charges will be your responsibility. In cases where the bank charges us a commission for receipt of your payment we reserve the right to charge you this sum on arrival.
  6. These prices are valid until December 31 2013 for courses beginning and ending in the year 2013.
  7. This price list over rules all previous information about prices and dates.
  8. don Quijote is not responsible for printing errors that may appear or for errors in publications by third parties about don Quijote.

ARTICLE 3 - INSURANCE

  1. Civil Liability: don Quijote has an accident and civil liability insurance policy that covers possible incidents or minor accidents that may occur within its centres. don Quijote is not responsible for the loss or theft of students’ personal property for which we recommend you take out your own insurance policy.
  2. We advise all citizens of the EU to bring the E111 document. If you require medical treatment with this document and the medical bill you will be able to reclaim the medical expenses back home.

ARTICLE 4 - TRAVEL DOCUMENTS

  1. Relevant travel documents may be arranged between a designated Travel Agent and the student or the student may make his/her own travel arrangements.
  2. Students themselves must arrange prior to departure all necessary travel documents in connection with their travel abroad i.e. valid passport, valid visa (if required), driver’s license, green card.
  3. Any costs, damages or other charges arising from cancellation or curtailment due to a student’s failure to comply with the above shall be the sole responsibility of the student.

ARTICLE 5 - LAST MINUTE RESERVATIONS AND CHANGES

  1. For the confirmation of reservations made 2 weeks or less before arrival (for Kids, Juniors and Teen programmes 4 weeks or less) the total amount must be paid in full at the time of enrolment.
  2. €100 (Spain and Cuba) / US$150 will be charged for administrative costs for changes to your confirmed reservation at any time after arrival (subject to availability)

ARTICLE 6 - COURSE REDUCTIONS AND CANCELLATIONS

  1. Cancellations before arrival will only be accepted up to and including the last working day before arrival and must be in writing (letter, e-mail or fax), cancellations made by telephone will not be deemed valid.
  2. For cancellation prior to the last two weeks before arrival there will be a loss of the advance payment of £85.
  3. For cancellation in the last two weeks before arrival there will be a penalisation of £425 (Spain) and £525 (Latin America). For Kids, Juniors and Teen Programmes the penalty will be £850 for cancellation in the last 4 weeks before arrival, for cancellation prior to the last 4 weeks before arrival the advance payment of £205 will not be refunded.
  4. In no case whatsoever will money for the course/accommodation be refunded once the course has started (except in the case of the refund guarantee).
  5. In all reimbursements an administration fee of 10% of the amount to be refunded will be charged (a minimum of £50) to cover the costs of returning your money, as well as the standard fee for changes in the reservation (£85).
  6. Students who require any type of invitation letter to obtain a student visa for their course and have to cancel due to denial of the visa must send an official original certified document directly from the Embassy. If this copy is not received by don Quijote 100% of the cost of the programme will be charged.
  7. Refunds must be requested within 30 days following completion of the course or cancellation. Once this period is complete the student no longer has the right to request any refund.
  8. In the event of a cancellation or course reduction original prices will be applied whether or not the student has opted for a special discount or promotion. For example if on booking the course the student received a discount due to the length of the course this will be lost on cancellation.
  9. Refunds can only be made and money can only be transferred to the student who booked the course. Refunds will never be made to anyone other than the student or the tutor who paid for the reservation.
  10. For the Spanish + Hotel Internship Programme there will be a cancellation fee of £383 for cancellations made more than 4-weeks before arrival. For cancellations in the last 4-weeks before arrival we will charge the whole programme price.

ARTICLE 7 - ALTERATIONS RESULTING FROM THE ACTIONS OF THIRD PARTIES

don Quijote does not accept any liability for changes in arrangements for transport, tuition, accommodation, insurance or any other matters made by other parties and any legal rights of redress which a student may have must be solely directed to such other parties

ARTICLE 8 – CUSTOMER SERVICE

  1. Notwithstanding the provisions of this agreement excluding legal obligation or liability on its part nevertheless don Quijote will in the event of a complaint by a student against an overseas body in connection with its preferred course or associated accommodation, use its best endeavours to rectify the situation to the reasonable satisfaction of the student involved provided that such complaint was notified to the appropriate secretariat abroad as soon as reasonably practicable and the student has exhausted all other reasonable practicable solutions in the overseas country involved.
  2. Any complaints need to be given in writing and within the first 24 hours otherwise students will lose the right to any compensation, refund or changes. don Quijote will accept any suggestions after departure date or requests only on an information level and to improve our services.

ARTICLE 9 – GOLD OR SILVER CANCELLATION GUARANTEE

  1. We recommend one of our special cancellation guarantees if you are taking a course of longer than 2-weeks. The cost of this guarantee is 6% (Silver) or 10% (Gold) of the total sum of the full programme invoice (the cost of the guarantee is non-refundable) and has to be paid in full upon reservation in order to be valid.
  2. The cancellation guarantee is personal and non-transferable and is only valid upon the students arrival at the school. Students who require and have obtained a visa through don Quijote can buy the cancellation guarantee but cancellations will only be considered once the student has provided proof of leaving the country. In these cases 8% of the amount to be refunded will be charged to cover administration costs.
  3. With the “Silver” cancellation guarantee you will be able to cancel your programme under certain circumstances: securing a job with a duration of at least one year; serious illness or accident resulting in hospitalisation; death of the insured, their spouse, direct descendents, siblings; being called to court proceedings or as a member of an electoral board; summons for major surgery with hospitalisation of the insured and their spouse; placement for the adoption of a child; organ transplant to or from the insured, their spouse, direct descendents, siblings, brother/sister in law, son/daughter in law, father/mother in law; the cancellation of a registered and insured companion obliging them to travel alone; bankruptcy of the travel agency or cancellation of the trip by the airline; natural disaster.
  4. With the “Gold” cancellation guarantee you can cancel all or part of the course for any reason.
  5. When a cancellation is made and you need to use the cancellation guarantee we will refund the cost of your course and accommodation if you cancel your course at any time from your arrival date until the end of your course. Your guaranteed refund will NOT include: your enrolment fee, the cost of one week and services already used at the time of cancellation, the cost of the guarantee itself and 4% of the amount to be refunded (minimum of £50) to cover administrative costs.
  6. In order to cancel a language programme the student must give notice via e-mail to seg@iegrupo.com. We will take the day following the day on which the e- mail is sent as the official cancellation day of the course. Until an e-mail is received the cancellation will not be valid. For this reason it is important that the student is certain that the e–mail has been received. If the student is covered under the Silver cancellation insurance then they will have a maximum of 15 days starting from the day the e–mail is sent to produce the necessary evidence to back up the motive for their cancellation.. If the student is covered by the Gold cancellation insurance this step is not necessary. The money will be returned within 30 days of the official cancellation date.
  7. If you have enroled for a course that is over 5-weeks long and you use the cancellation guarantee you should be aware that prices may change depending on how many weeks you will be doing eventually. That is if you enroled for 12-weeks and unfortunately you need to reduce your course to 4-weeks the 4-week prices will be applied.
  8. The cancellation guarantee insurance is only available for courses in Spain and Mexico.

ARTICLE 10 - MEDICAL INSURANCE

We advise all citizens of the EU to bring the E111 document. If you require medical treatment, with this document and the medical bill you will be able to reclaim the medical expenses back home.

ARTICLE 11 – CLASSES

  1. In high season some classes may be given in classrooms outside of our installations.
  2. don Quijote’s management reserves the right to extend the timetable for classes to 9.00 pm.
  3. In the exceptional case that only 1 or 2 students are enroled on a course in the same level group the school reserves the right to change a group course into One to One tuition. In this case class hours will be reduced by 50%.

ARTICLE 12 – ACCOMMODATION

  1. The student will be charged for the replacement of broken items due to either negligence or by intention.
  2. If there is damage and no one is directly responsible, we will divide the cost of repairs among all the students in the flat or residence.
  3. In high season the flats and student residences may be substituted by another type of accommodation at a corresponding price.
  4. In the case of a serious disciplinary offence or repeated bad behaviour the student will be expelled from the accommodation contracted with don Quijote without the right to any refund.
  5. If you reserve a shared double room (shared with another student) and there is no other student with whom you can share the room we reserve the right to change your room at any time.

ARTICLE 13 – ADMISSION OR EXPULSION

  1. don Quijote reserves the right to cancel the student’s place if on the day of their arrival they have not paid the total sum of the course, accommodation and other services contracted.
  2. In the case of a serious disciplinary offence, repeated bad behaviour or infringement of the laws of the country in which the course is taking place, the student will be expelled from the school and accommodation contracted with don Quijote without the right to any refund.
  3. In the case where damages are caused to third parties, all the expenses claimed from don Quijote that originate from the above-mentioned incident will be charged to the student, who will have no right to later claims.
  4. The don Quijote management reserves the right to accept students aged 16 or under (Spain) / 13 or under (Mexico) in exceptional cases.

ARTICLE 14 – COPYRIGHT

The management of don Quijote reserves the right to use all possible photos taken during the student’s stay unless the student declares otherwise on his arrival at the school

ARTICLE 15-HOLIDAYS

  1. Please check our website www.donquijote.org/holidays for updated holidays before your trip as they may be subject to change.
  2. don Quijote is not obliged to refund or make up any classes missed due to National and Local Holidays. In the case of two holidays within one week (Monday-Friday) one day of the missed lessons will be recouped except for One to One classes which will be recouped in any case.

ARTICLE 16-OFFERS AND DISCOUNTS

  1. The Enrolment Fee is valid for one year from the first reservation made for don Quijote schools. In other words any course reserved during this year can be made using the same enrolment fee.
  2. Our published offers or other types of discounts cannot be accumulated and are subject to availability and have a fixed duration period. They cannot be used in conjunction with one another and are only applicable when students are eligible for them when enroling. Discounts that become available after the first enrolment are not valid.
  3. Credit Notes are only valid for up to 12 months from the credit note start date. Once this period of 12 months comes to an end the student loses the right to the credit.

ARTICLE 17-REFUNDS

  1. Refer back to articles 6 and 9.
  2. Following the request or after the examination of all documents in the case of the cancellation guarantee a refund will be made within 30 days.
  3. Refunds can only be made and money can only be transferred to the student who booked the course. Refunds will never be made to anyone other than the student or the tutor who paid for the reservation.
  4. For all refunds we will charge an administrative fee of 10% of the amount to be refunded (a minimum of £50).

ARTICLE 18-OFFERS

The published offers cannot be accumulated. All offers are subject to availability. There will be no changes made to bookings that have been received prior to the promotion. All offers and promotions will be applied at the time of booking.

PROTECTION OF PERSONAL DATA

In compliance with Spanish Law 15/1999 December 13, regarding the protection of personal data, don Quijote would like to inform you that your personal details within these general conditions will be stored in a database (whose liability and responsibility is dQ, S.L.) solely for the commercial and operative uses of the company. By accepting these general conditions you give your consent to the above said treatment and for their use for the aforementioned purposes. At the same time you have the right to request that we inform you of your rights to access, correct and cancel such information within the established terms of the prevailing legislation in writing to the address at: Calle Placentinos 2, 37008 Salamanca, Spain.

CONDITIONS OF OUR TRIPLE GUARANTEE

  1. 100% Price Guarantee – for purposes of invoking the 100% Price Guarantee (applicable to Spanish language courses only, accommodation is excluded), the other programme’s price needs to be at least £10 less than don Quijote’s / budget friendly’s published price AND the programme needs to be comparable. Comparable means: in the same city, an equal amount (or more) of Spanish instruction time, same (or fewer) maximum students per class, same quality of instruction don Quijote / budget friendly school reserves the right to disqualify certain Programmes where the quality of instruction may be in question. This is determined by several factors including teachers’ qualifications, years in business, international recognition and qualifications. Simply include a copy of the other organisation’s price sheet or a link to their website where the price is in print. As long as the programme is equivalent to our programme we will honour their price and discount another 20% of your enrolment fee.
  2. Satisfaction Guarantee – your satisfaction is our main concern. If on your arrival you are not satisfied with any of our services just notify the school secretariat in writing within 24 hours of your first course day (these apply as well as for any problems that might occur during your stay). We’ll rectify the situation within 2 working days. If you still feel that the services are not in accordance with the brochure description we’ll sit down and talk it out with 2 possible outcomes. Either we’ll agree that the service has not met our guarantee and refund your course and accommodation fees or if we can’t agree we’ll allow an independent arbitrator appointed by the regional Spanish government to determine if the situation warrants application of our money back guarantee.
  3. Cancellation Guarantee – when you purchase one of our cancellation guarantees you protect yourself against the unexpected events that might cause you to cancel your course. For full details see Article 9.
